Alabama Sues Drummer Mark Herndon

6/10/2008 Lisa Ann Schleipfer Mark Herndon, drummer for the Country Music group Alabama, is being sued by his band mates. Randy Owen, Jeff Cook and Teddy Gentry have filed suit in DeKalb County, Ala., for a an approximate $200,000. The suit alleges that Herndon was overpayed the two hundred thousand dollars from the band's 2003 farewell tour. The band members claim Herndon was paid from merchandise sales from that tour before the final accounting was completed. The group wants Herndon to pay back the total check, which comes to $202,670. The suit is requesting Herndon's future earnings be withheld until the full amount is repaid. Herndon is racking up negative points—he also asked for a $65,047 advance from the sales of Alabama's concert CD The Last Stand, sold in Cracker Barrel stores. Alabama was inducted into the Country Music Hall of Fame in 2005, recently had bronzed statues of all four band members unveiled in Fort Payne, Ala.
